1. Acceptance of Terms

By using bookhead.net, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Account Registration and Passwords

To access certain features of our Services, including our e-commerce platform and ISBN Magic application, you must create an account. You must provide accurate and complete information during the registration process. You are solely responsible for any activity that occurs on your account and must keep your password and/or API key confidential. You agree to promptly notify us of any unauthorized use of your account. We reserve the right to close your account at any time for any or no reason.

3. Additional Terms & Guidelines

When using the Site or Services, you will be subject to any additional posted guidelines or rules applicable to specific services and features which may be posted from time to time (the “Guidelines”). All such Guidelines are hereby incorporated by reference into these Terms. Such additional terms and guidelines include third-party licenses that may apply to other data on bookhead.net.

4. Use of Data and Content

By using the Site you represent and warrant that any User Content posted by you does not contain material or links to material that infringes upon a third party’s intellectual property or proprietary rights including, without limitation, copyright, patent, trademark, trade secrets, or rights of publicity or privacy. You agree to accept full liability and responsibility for all User Content submitted by you or on your behalf for posting on the Site.

5. ISBN Magic

If you use our ISBN Magic application, API, or any other ISBN Magic add-on, you acknowledge and agree that you are responsible for removing any data associated with ISBN Magic upon termination of your subscription.

ISBN Magic’s use and transfer of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

6. Third-Party Services and Integrations

Bookhead integrates with third-party platforms including Shopify, Squarespace, Booklog, IBIDie, iMRCHNT, eBay, Biblio, and Canva. Your use of these platforms is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or policies of third-party services.

You are responsible for maintaining valid credentials and permissions for any connected platforms. If a third-party platform changes its API, terms, or availability, Bookhead will make reasonable efforts to maintain compatibility but cannot guarantee uninterrupted integration.

7. Subscription Plans and Billing

Bookhead offers free and paid subscription plans. Features, product limits, and pricing for each plan are described on our pricing page.

For Shopify Merchants, all paid plan charges are billed through Shopify’s billing system and appear on your Shopify invoice. You can upgrade or downgrade your plan at any time from within the app. Cancellation of your paid plan stops future billing at the end of your current billing period.

For non-Shopify Merchants, billing is processed through Stripe. You may cancel your subscription at any time by contacting support@bookhead.net or through your account settings.

We reserve the right to change our pricing with 30 days’ notice. Price changes do not apply retroactively to the current billing period.

Upon cancellation or downgrade:

  • Your synced products remain in your Shopify store (or other connected platform). Bookhead does not remove products it has created.
  • Automatic sync and updates will stop at the end of your billing period.
  • Your Bookhead account data is retained for up to 12 months in case you choose to resubscribe, after which it is deleted per our Privacy Policy.

8. Data Ownership

You retain full ownership of your inventory data, product information, and any content you provide to Bookhead. By using our Services, you grant Bookhead a limited, non-exclusive license to process, transmit, and display your data solely for the purpose of providing the Services.

Products created by Bookhead in your Shopify store (or other connected platforms) belong to you. If you uninstall Bookhead or cancel your subscription, those products remain in your store under your control.

Bookhead does not claim any ownership rights over your data. Upon account deletion, we will delete your data in accordance with the timelines described in our Privacy Policy.

This section does not apply to third-party bibliographic metadata (such as book titles, authors, descriptions, and cover images) sourced from external databases. Such data remains subject to the terms of its respective providers.

9. Modifications and Availability

We reserve the right to modify, suspend, or discontinue any part of our Services at any time and for any reason, without notice. We are not liable for any loss or damages resulting from the unavailability of our Services.

10. Intellectual Property

The materials, design, code, and content on Bookhead are protected by intellectual property laws and are the property of Bookhead or its licensors. You may not distribute, modify, copy, or reproduce these materials without our prior written consent.

11. Privacy

Your privacy is important to us. Our Privacy Policy outlines how we collect, use, and protect your personal information when you use our Services.

12. Service Availability and Limitations of Liability

Bookhead will make reasonable efforts to maintain the availability and reliability of our Services, including inventory synchronization and product updates. However, we provide our Services on an “as-is” and “as available” basis and do not guarantee uninterrupted or error-free operation.

We are not liable for any loss, damage, or harm resulting from:

  • Temporary unavailability of our Services due to maintenance, updates, or circumstances beyond our control
  • Sync delays, data discrepancies, or errors caused by third-party platform outages or API changes
  • Actions taken by third-party platforms that affect your store or data
  • Your reliance on our Services as the sole method of inventory management without independent verification

To the maximum extent permitted by law, Bookhead’s total liability for any claims arising from your use of our Services is limited to the amount you paid to Bookhead in the 12 months preceding the claim.

13. Indemnity

You agree to indemnify and hold harmless Bookhead, its affiliates, partners, and employees from any claims, damages, liabilities, and expenses arising from your use of our Services or any breach of these Terms.

14. Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms or for any other reason. You may also terminate your account by discontinuing your use of our Services.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the state of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware.

16. Changes to Terms

We may update these Terms from time to time. The updated Terms will be posted on this webpage and we’ll notify you of changes. Your continued use of our Services after the changes constitute your acceptance of the updated Terms.
